TERMS OF SERVICE

 

If you are using the Site, Application or Services and you reside in the USA, you are contracting with Airmule, Inc. with respect to use of the Airmule Site, Application or Services with respect to any payments or payouts from or to you conducted through the Site, Application or Services.

 

Airmule provides an online platform that enables Travelers to connect with Shippers (“Senders”) seeking to ship items with a Courier (collectively, the “Services”), which Services are accessible at http://www.airmule.com and any other websites through which Airmule makes the Services available (collectively, the “Site”) and as applications for mobile devices (the “Application”). By using the Site or Application, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service (“Terms”), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Site, Application and Services and all Collective Content (defined below), and your participation in the Referral Program (defined below), and constitute a binding legal agreement between you and Airmule. Please also read carefully our Privacy Policy at http://www.airmule.com/privacy. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Site, Application or Services. Failure to use the Site, Application or Services in accordance with these Terms may subject you to civil and criminal penalties.

 

Eligibility

 

The Site, Application and Services are intended solely for persons who are 18 or older. Any access to or use of the Site, Application or Services by anyone under 18 is expressly prohibited. By accessing or using the Site, Application or Services you represent and warrant that you are 18 or older.

 

How the Site, Application and Services Work

 

The Site, Application and Services can be used to facilitate the listing of air courier services and arranging of and payment for transportation of shipments by couriers. If you wish to list travel plans, you must first register to create an Airmule Account.  Senders may only use the platform after applying to be a Sender including, but not limited to submitting their TSA Indirect Air Courier Certification Number or their TSA Known Shipper number.

 

As stated above, Airmule makes available an online platform or marketplace with related technology for Couriers to list trips and Senders to place shipment orders. Airmule staff or employees, or affiliates are not the Senders.

 

Members create an account by entering their cell phone number, email address and a password. Couriers may be required to provide a photo of their driver’s license or passport for identity confirmation. Couriers may also be required to provide their Social Security number in order to receive payment to their bank account and for tax purposes. Couriers list their air travel itinerary details and how many checked bags space are available for Courier shipping. Couriers must provide a US Bank account information to receive payment upon delivery. Airmule utilizes Stripe as it’s payment provider.

 

Courier will receive notification if they have a Shipment at least 6 hours before departure. Airmule staff or contractors will arrange delivery of Shipment to Courier at their departure airport and pickup from destination airport. If Courier is an Airmule Flights Customer they are guaranteed to have a Shipment and are required not to depart without Shipment unless expressed in writing by Airmule.

 

Couriers can view their income balance at anytime in their account view. Couriers enter a valid U.S. bank account and request a withdrawal at anytime. Funds are usually available within 2 to 3 days of a confirmed delivery.

 

Courier Requirements

 

Couriers are required to be at least 18 years old, be a U.S. citizen or resident, and have a valid U.S. bank account. Couriers may be required to upload a copy of their U.S. issued driver’s license or passport.

 

Duty and Tax

 

The Sender agrees to declare if the item they are shipping is for commercial purposes or if duty or tax is due on the item upon entry into a country. If the item requires a duty or tax, Sender is required to pay the entire fees associated with the items. If documentation is required to enter the country with the item, the Sender agrees to provide all documentation necessary.

 

Courier shall not be responsible for any customs clearance activity unless expressly told prior to accepting Shipment. Courier shall not be held responsible for any duty or tax fees. Airmule contracts with customs brokers when required.  Courier is not liable to any Shipments transported into the country.

 

Airmule ensures that all Shipments comply with known foreign entry and duty laws.

 

Payment

 

As a Courier, you will receive applicable Delivery Fee per checked luggage space as listed on Airmule.com for the route you are servicing. Airmule will process all payments due to you through Stripe, its third-party payments processor.  Airmule reserves the right to withhold all or a portion of Delivery Fees if it believes that you have attempted to defraud or abuse Airmule or Airmule’s payment systems.

 

Insurance

AIRMULE provides insurance up to $300 per shipment. Any shipment that requires insurance over $300 will be subjected to an additional fee. This fee shall be 5% of the IDV. For example purposes, if the IDV of an item is $1000 and a Customer requests to purchase insurance for the entire value of the item, the fee shall be 5% multiplied by the (IDV minus $300). 5% x ($1000 – $300) = $35. Insurance only covers damage or loss while the shipment is in AIRMULE’s possession. AIRMULE cannot be held responsible if an airline loses an Item or Shipment, or if Customs takes possession or destroys the shipment. AIRMULE will not be responsible if there is consequential damage that results from the delay, damage or loss of a Shipment. If a Customer has a valid claim, they will receive reimbursement within three to ten (3 ~10) business days. Proof of purchase price is required to receive the full claim.

Customs clearance can be time consuming. Airmule will reimburse the shipment up to 3X of the insurance “fee” to cover the delay shipping cost.

 

Liability

PLEASE NOTE THAT, AS STATED ABOVE, THE SITE, APPLICATION AND SERVICES ARE INTENDED TO BE USED TO FACILITATE COURIERS PROVIDING SHIPPING SERVICES TO SENDERS. AIRMULE SCREENS AND CERTIFIES ALL THE CONTENTS CONTAINED IN PACKAGES AND THE CONDITION, LEGALITY OR SUITABILITY OF ALL ITEMS AND LUGGAGE. AIRMULE SHALL PROVIDE TO COURIER A MANIFEST INCLUDING PHOTOS, DESCRIPTIONS AND VALUES OF ALL SHIPMENTS.  COURIERS ARE WELCOME TO INSPECT ALL SHIPMENTS PRIOR TO TRAVEL.  COURIER IS NOT LIABLE FOR THE CONTENTS OF ALL THE ITEMS CONTAINED ON THE MANIFEST.

Export Control

REQUIRE BY BUREAU OF INDUSTRY AND SECURITY, DEPARTMENT OF COMMERCE, AND  TRANSPORTATION AND SECURITY ADMINISTRATION,  Sender MUST aware of US Export Control Policy. It is the Sender’s responsibility to ensure all shipment information is provided is correct and compiled. TERMS OF SERVICE

If you are using the Site, Application or Services and you reside in the USA, you are contracting with Airmule, Inc. with respect to use of the Airmule Site, Application or Services with respect to any payments or payouts from or to you conducted through the Site, Application or Services.

Airmule provides an online platform that enables Shippers (“Senders”)  to connect with Travelers who willing to courier (collectively, the “Services”) shipments, which Services are accessible at http://www.airmule.com and any other websites through which Airmule makes the Services available (collectively, the “Site”) and as applications for mobile devices (the “Application”). By using the Site or Application, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service (“Terms”), whether or not you become a registered user of the Services. Definitions

“Airmule Air Waybill” means any shipping document, label, electronic entry or similar item used in the Airmule system for the services described in these terms and conditions. Originals must be used (photocopies are not accepted).

“Billable Weight” and “Chargeable Weight” mean the weight used to calculate the rate. The billable weight and chargeable weight are the greater of actual or dimensional weight.

“Business day” means Monday through Friday except for the following U.S. holidays:

Memorial Day New Year’s Day Independence Day Constitution Day (Puerto Rico only) Labor Day Good Friday (Puerto Rico only) Thanksgiving Day Three Kings Day (Puerto Rico only) Christmas Day

 

“Customer,” “sender” or “shipper” means the person whose name is listed on the air waybill as the sender.

 

“Package” means any single parcel or piece with a chargeable weight of 40 lbs. or less. Any fraction of a pound is rounded up to the next-higher pound.

 

“Recipient” or “consignee” means the person whose name is listed on the air waybill as the recipient.

 

“Shipment” means one or more pieces, either packages or freight, moving on a single air waybill.

 

“You” or “your” means the shipper/sender, recipient and their agents, servants, employees, and any other person or entity having or claiming an interest in a shipment.

 

Non-Waiver

Any failure by us to enforce or apply a term, condition or provision of the FedEx Service Guide does not constitute a waiver of that term, condition or provision and does not otherwise impair our right to enforce such term, condition or provision.

Undeliverable Shipments

An undeliverable shipment is one that cannot be delivered for reasons that include, but are not limited to, any of the following:

  • The recipient refuses to pay for a bill-recipient shipment.
  • The recipient refuses to accept the shipment prior to, during or after delivery.
  • The recipient’s delivery address cannot be located.
  • The shipment was addressed to an area not served by Airmule.
  • The shipment’s contents or packaging are damaged to the point that rewrapping is not possible. • The shipment is unable to clear customs.
  • The shipment would likely cause damage or delay to other shipments or property or injury to personnel.
  • The shipment contains prohibited items.
  • The recipient’s place of business is closed.
  • No appropriate person was available to accept the shipment at a delivery location on the initial delivery attempt or reattempts.
  • The shipment was improperly packaged.
  • The recipient of a Hold at Location shipment cannot be located.

 

Should a shipment be classified as undeliverable or unidentifiable, the following guidelines apply:

 

  1. If a shipment is undeliverable for any reason, we may attempt to notify the sender to arrange for the return of the shipment if local customs regulations will allow. If the sender cannot be contacted within five business days, we may place the shipment in a general order warehouse or will dispose of the shipment. Airmule reserves the right, at its sole discretion, and without notice, to sell, destroy or otherwise dispose of undeliverable shipments. By tendering a shipment, the shipper agrees to transfer and convey good and sufficient title of the contents of undeliverable shipments to Airmule, and agrees to pay any costs incurred in returning, storing or in the sale, destruction or disposal thereof.
  2. For shipments returned from international points to the U.S., return charges and fees will be assessed to the original shipper, along with the original charges and fees. Also included will be any other charges incurred by us, including, but not limited to, duties, taxes, clearance fees and storage fees*, if applicable. For returned shipments containing dangerous goods, the shipper must supply a completed return air waybill and all other required documents.
  3. Shipments that cannot be returned due to local regulatory constraints will either be placed in a general order warehouse or disposed of at our sole discretion and at any location. The shipper agrees to pay any costs incurred by Airmule in such placement or disposal.

The Site, Application and Services can be used to facilitate the listing of air courier services and payment for transportation of shipments by couriers. Senders may use the platform after applying to be a Sender including, but not limited to submitting their TSA Indirect Air Courier Certification Number or their TSA Known Shipper number.

Airmule launches an advanced algorithm to ensure Shipments and Courier are matched in the most relevant routes, which result in the most efficiency and fastest delivery.

As stated above, Airmule makes available an online platform or marketplace with related technology for Couriers to list trips and Senders to place shipment orders. Airmule staff or employees, or affiliates are not the Senders.

Fees

Shipping Fee, Airmule charges shipping fee based on chargeable weight.

Surcharge Fee, in order to provide a quality service, Airmule may increase a “surcharge fee” per category of shipments based on the demand (total available shipments) and supply (total available couriers).

Storage Fee, as the platform, it’s our responsibility to hold shipments for Sender under certain circumstance, eg: Shipment forward, flight delayed, cancel shipments etc. For any situation, Airmule provide free 14 days storage for any shipment, beginning from the day of event occurs. After the free storage period, a $0.25 per pound per day storage fee may applied to the shipment.
